§1. General Provisions

  • These Terms of Service govern the use of the website available at www.karpiowakuchnia.pl, hereinafter referred to as the "Service".

    hereinafter referred to as the "Administrator".
  • The Terms of Service are available free of charge on the Service.
  • Using the Service implies acceptance of these Terms of Service.

§2. Scope of Services

  • The Service enables:

    • browsing publicly available informational content,
    • creating and managing user accounts,
    • managing carp bait production recipes,
    • managing ingredient inventory,
    • manual and automatic creation of shopping lists,
    • automatic updating of inventory levels,
    • searching for ingredients from multiple manufacturers in one place.
  • Some Service content is available without the need for registration.
  • Features such as recipes, ingredient storage, and shopping lists are available exclusively to logged-in users.

§3. Registration and User Account

  • An account on the Service may be created by a person who has reached 16 years of age, and in the case of a minor – with the consent of a legal guardian.
  • The user is obliged to provide truthful information.
  • The user bears full responsibility for actions taken using their account.
  • A user account may be:

    • deleted upon request after contacting the Administrator,
    • blocked or deleted by the Administrator in case of violation of the Terms of Service or legal provisions.
  • After account deletion, all user data is permanently deleted.

§4. Subscriptions

  • The Service offers three types of subscriptions:

    • Free
    • Standard
    • Expert
  • Paid subscriptions are concluded for a fixed period of 12 months and do not renew automatically.
  • Failure to extend a subscription results in its automatic expiration.
  • A 60-day trial period for the Standard subscription is available.
  • Scope of functionality:

    • Free:

      • up to 3 recipes,
      • up to 25 ingredients in storage,
      • 1 active shopping list created manually,
      • no ability to save different recipe versions.
    • Standard:

      • up to 10 recipes,
      • up to 5 versions of one recipe,
      • up to 100 ingredients in storage,
      • up to 10 active shopping lists,
      • ability to automatically create shopping lists.
    • Expert:

      • up to 25 versions of one recipe,
      • no other limitations.
  • Subscription prices are gross prices and include VAT (23%), unless otherwise indicated.
  • In case of expiration of a Standard or Expert subscription, the user's account is transferred to the Free subscription scope. Data exceeding Free subscription limits is not deleted, however the user loses the ability to edit, modify, or add new items beyond Free version limits.
  • After transitioning to a Free subscription, or downgrading from Expert to Standard or Free, the user can only edit data within the limits of the free Service version. The limit will be counted according to the creation date of a given resource, allowing editing of the newest resources and blocking editing of the oldest resources exceeding the limit.
  • In case of upgrading the subscription from Standard to Expert, the user gains access to functionalities resulting from the higher plan. Unused limits of the Standard subscription are not transferred or accumulated with the Expert subscription limit.
  • Full access to data editing is restored upon reactivation of the appropriate subscription.
  • A subscription cannot be cancelled during its duration.
  • The user is not entitled to a refund for an unused subscription period.
  • By purchasing a subscription, the user consents to immediate commencement of digital service provision.
  • The user is informed and acknowledges that in accordance with Article 38, point 13 of the Consumer Rights Act, they lose the right to a 14-day withdrawal from a distance contract.
  • A subscription is a digital service, and its purchase implies acceptance of the terms of this service provision.
  • The subscription is activated immediately upon payment, and the user gains access to functionalities corresponding to the purchased subscription plan and subscription period.
  • The subscription period is determined at the time of purchase and is not subject to changes.
  • Subscription renewal is possible 30 days before its expiration.
  • Purchasing a new subscription is available at any time, and its period begins immediately upon payment.
  • Upgrading the subscription to a higher plan is possible at any time. The user may choose whether the subscription should be activated immediately upon payment or after the current subscription expires.
  • The Administrator reserves the right to introduce new Service functionalities, which will be successively added to the offer and assigned to individual subscription types.
  • The availability of new functionalities may depend on the subscription held and does not constitute a change in the terms of an already concluded agreement.

§5. Payments

  • Subscription prices are listed on the Service website and may change. Current prices are available on the Service.
  • Subscription payments are processed exclusively through the online payment system.
  • The entity providing online payment services is Autopay S.A.
  • Available payment methods:

    • BLIK
    • Payment cards:

      • Visa
      • Visa Electron
      • Mastercard
      • Mastercard Electronic
      • Maestro
    • Fast online bank transfers
  • The subscription sale agreement is concluded at the moment of payment by the user.
  • The order will be fulfilled immediately after receiving a positive payment authorization.
  • An invoice/receipt will be issued and sent to the user at the email address provided during the subscription purchase process within 7 days of receiving a positive payment authorization.
  • If a refund is required for a transaction made by a customer using a payment card, the seller will refund the amount to the bank account associated with the customer's payment card within 14 days of receiving refund information from the online payment operator.
  • The seller makes the refund using the same payment method as used by the consumer, unless the consumer has expressly agreed to a different refund method that does not incur any costs for them.

§6. Promotions and Discounts

  • The Administrator may organize promotions and discount campaigns related to subscriptions, the terms of which will be specified each time on the Service.
  • Promotions may include, among others, extension of the subscription period, price reduction, or granting additional functionalities.
  • Promotional (discount) codes may be single-use or multi-use, depending on the terms of the given promotion.
  • A promotional code may only be used during its validity period and in accordance with the terms specified for the given promotion.
  • Promotions cannot be combined with each other, unless the terms of the given promotion state otherwise.
  • The Administrator reserves the right to end or change the terms of a promotion at any time, without affecting orders already completed.
  • Current promotions:

    • Welcome bonus: With the first purchase of a paid subscription (Standard or Expert), the user receives an additional 3 months of the selected plan for free. The bonus is applied automatically and does not require a promotional code.

§7. User Content, Copyright, Buyer Obligations and Liability

  • The user owns the copyright to recipes created by them.
  • User recipes are visible only to them.
  • The user does not own copyrights to descriptions of manufacturers, suppliers, and ingredients.
  • The Administrator is not responsible for content added by users.
  • The Administrator has the right to remove content:

    • inconsistent with the law,
    • violating the Terms of Service,
    • violating the rights of third parties.
  • The user bears full responsibility for content they add to the Service.
  • The user is obliged to use the Service in a manner consistent with the law, good customs, and the Terms of Service.
  • The user may not share their account with other people or use other users' accounts. The Administrator is not responsible for damages resulting from violation of this prohibition.
  • The user is obliged to report to the Administrator any violations of the Terms of Service or legal provisions they witness on the Service.
  • The user is obliged to report any errors, defects, or technical problems related to the operation of the Service that may affect its functioning or security.

§8. Administrator Liability and Obligations

  • The Service is informational and hobby-oriented in nature.
  • The Administrator is not responsible for:

    • effectiveness of recipes,
    • fishing results,
    • decisions made based on Service content.
  • Information about ingredients comes from manufacturers, suppliers, sellers, and users.
  • The Administrator has made every effort to ensure the Service is free from errors and defects, however does not guarantee its uninterrupted operation.
  • The Administrator is obliged to promptly remove any content that violates the law, Terms of Service, or the rights of third parties upon receiving a report from users or other persons.
  • The Administrator is obliged to ensure the security of users' personal data in accordance with applicable legal provisions and the Privacy Policy.
  • The Administrator is obliged to fix technical defects that may affect the functioning or security of the Service as soon as possible after their detection or reporting.
  • The Administrator is obliged to provide technical support for users in case of problems with the Service operation, including responding to reports regarding errors, defects, or other technical issues.
  • The Administrator is obliged to ensure access to the Service and its functionalities throughout the duration of the subscription.
  • The Administrator reserves the right to make changes to the Service that may affect its functionality, appearance, or usage method, however not contradicting the Terms of Service.
  • The Administrator reserves the right to temporarily or permanently suspend the Service operation in case of the need to perform maintenance, updates, or other technical activities that may affect its availability.

§9. Complaints

  • Complaints regarding the Service operation and subscription purchases should be submitted to: kontakt@karpiowakuchnia.pl
  • Help and complaints regarding the Autopay payment system can be found at: https://pomoc.autopay.pl
  • Complaints are processed within 14 days.

§10. Personal Data

  • Personal data is processed in accordance with applicable legal provisions and the Privacy Policy.
  • The personal data controller is the Service Administrator.

§11. Final Provisions

  • The Administrator reserves the right to change the Terms of Service.
  • Changes to the Terms of Service take effect from the moment of their publication on the Service.
  • In matters not regulated by the Terms of Service, Polish law applies.
